About this Case

News of the execution of Mr. Babakhan Valipur was published on the websites of Central News Unit and ILNA (Iranian Labor News Agency) on February 25, 2015. Additional information was gathered from the websites of Kayhan on August 25, 2008, Lorestan Courthouse on October 11, 2009, and Fars news agency on October 11, 2009 and April 17, 2010.         

Arrest and Detention

According to ILNA, quoting the Public Prosecutor of Khorramabad, Mr. Valipur was arrested in 2006. There is no specific information on his arrest and detention.

Trial

Branch 102 of the Khorramabad Court tried this case and issued a ruling in October of 2010. According to the Fars news agency report, quoting the Public Relations Office of the Lorestan Courthouse, after Mr. Valipur’s attorneys appealed, the ruling was referred to Branch One of the Supreme Court. After investigation and based on the qualification of the Provincial Appeal Courts for such cases, it was referred to the Province. Since the objection of the defendant and his attorneys was not based on any of the four conditions mentioned in Article 240* of the Criminal Code of Procedure, Branch 10 of the Appeal Court confirmed the ruling based on Article 250** of the Criminal Code of Procedure. No further information is available on Mr. Valipur’s trial.  

Charges

According to the website of the Lorestan Courthouse, the charges against Mr. Valipur were announced as "fraud, receiving large amounts of money from people for investment resulting in embezzlement, and earning profit through illegitimate means." According to the Kayhan newspaper, Mr. Valipur and his collaborators received money from people for buying vehicles but did not deliver the vehicles.        

Evidence of Guilt

According to the Kayhan newspaper, quoting the Head of the Public Relations Office of the Lorestan Courthouse, the evidence presented against Mr. Valipur was the complaint of 1,323 individuals who claimed 18.6 Billion Tumans.  

Defense

No information is available on Mr. Valipur’s defense.    

Judgment

The Court condemned Mr. Babakhan Valipur to death and the Supreme Court confirmed the ruling. He was hanged in Khorramabad on February 25, 2015.

*Article 240 – An appeal can be requested in the following instances:

A- Claiming that the documents referred to by the court were invalid, or a lack of legality in the testimonies of the witnesses, or that there were false statements made by the witnesses.

B- Claiming that the sentence is against the law.

C- Claiming that the judge did not pay attention to the expressed reasons.

D- Claiming the judge or issuing court is incompetent.
