About this Case

The news of the execution of Mr. Abolhassan B. along with three other individuals was announced by the websites of E’temad daily (March 14, 2009) and Khabar-e Jonoub daily (March 12, 2009). Additional information regarding this case was obtained from the website of Khabar-e Jonoub daily on September 17, 2009. Mr. Abolhassan B., 73, was from Firouzabad and used to live in Sepidan in Fars Province. In 1981, he had had a quarrel with his cousin in Firouzabad over irrigation water. Mr. Abolhassan B.’s case pertains to the death of his cousin on November 30, 1981.

Arrest and Detention

Mr. Abolhassan B. was arrested by the police in the city of Sepidan in 2001. The police force of Firouzabad, after finding the body of Mr. Abolhassan B.’s cousin by a brook in Firouzabad, had begun to investigate Mr. Abolhassan B. as a suspect the year of the incident. Twenty years after the incident, the police identified Mr. Abolhassan B. After acquiring judicial permission, they arrested Mr. Abolhassan B. and moved him to the office of the Judiciary Police.

Trial

Mr. Abolhassan B. was tried by Branch Two of the Public Court of Firouzabad in the presence of the victim’s family. However, there is no information available on the session or sessions of his trial.

Charges

The court charged Mr. Abolhassan B. with murder. He was accused of fatally shooting his cousin. The validity of the criminal charges brought against this defendant cannot be ascertained in the absence of the basic guarantees of a fair trial.

Evidence of Guilt

According to the available information, the expert opinion of the coroner that the victim had died as a result of acute internal hemorrhage and shock, as well as the body of the victim, were among the pieces of evidence that were entered against Mr. Abolhassan B.

Defense

Mr. Abolhassan B. pleaded “not guilty” during the trial. He did not confess to the murder during the initial phase of police investigation and interrogation, nor did he make such a confession in court . According to the available information, during the court proceedings Mr. Abolhassan B. stated that the bullet he had fired had not hit the victim, and he therefore was not the murderer. He also added that during the dispute, his nephew had also been present with a gun, and that he might have been the one who murdered the victim.

Judgment

Branch Two of the Public Court of Firouzabad sentenced Mr. Abolhassan B. to death. Branch 26 of the Supreme Court approved the verdict. After the permission of the high-level judicial authorities had been secured, Mr. Abolhassan B. was hanged in Shiraz’s Adelabad Prison on the morning of March 11, 2009.
