About this Case

News of the execution of an unknown individual, along with two others, was published on the website of ISNA (Iranian Students News Agency) on January 31, 2004, quoting the Head of the Public Relations Office of the Azerbaijan-e Gharbi Courthouse, on February 17, 2004, quoting the Head of Prison Administration in Khoy, and in the Jomhuri Eslami newspaper on February 4, 2004. The cases against these individuals were related to kidnapping and murder of a young girl, 15 or 16 years old, on December 10, 2003.

Arrest and detention

This individual and the other two defendants were arrested by the Special Police Forces shortly after the alleged crime took place. They were detained for less than two months at the Khoy Prison. The circumstances of his arrest and detention are not known.

Trial

Branch 11 of the General Court of Khoy tried this defendant. According to the Jomhuri Eslami newspaper, this trial was open to public. No information is available on his trial.

Charges

According to the Head of Prison Administration in Khoy, the charges brought against this defendant and the other two defendants were collectively announced as “kidnapping and rape.”  

The validity of the criminal charges brought against this defendant cannot be ascertained in the absence of the basic guarantees of a fair trial.

Evidence of guilt

The report of this execution did not provide any specific information on the evidence presented against the defendant.

Defense

After arrest, the interrogation, trial, and prosecution of this defendant and the other two took about 50 days before their execution (Jomhuri Eslami newspaper). He objected to the ruling and his case was referred to the Supreme Court. However, no information is available on his defense.

Judgment

Branch 11 of the General Court of Khoy condemned the defendant to death and Branch 32 of the Supreme Court confirmed the ruling. He was hanged, along with two others, in public at Vali’asr Square in Khoy on January 31, 2004.
