About this Case

Information regarding Mr. Mo’ini’s case was collected from an Eform which his daughter sent to the Abdorrahman Boroumand Foundation (ABF) on 3 November 2011 and a news report by Kayhan Daily on 12 April 1979.

Mr. Mo’ini was the Head of SAVAK (the intelligence organization under the Shah) in Qom. He was married with three children. He had a high school diploma in mathematics (ABF Eform).

Arrest and detention

Mr. Mo’ini surrendered himself to the Revolutionary Tribunals in Qom to declare solidarity with the revolutionists (ABF Eform).

Trial

The Revolutionary Tribunal of Qom tried Mr. Mo’ini (Kayhan). Kayhan reported that the trial was public and that a Kayhan reporter had an interview with Mr. Mo’ini. But his daughter noted that her father’s trial was closed. It is not clear how Kayhan’s reporter could have accessed the defendant for an interview (Kayhan, ABF Eform).

Charges

Mr. Mo’ini’s charges consisted of the following: “waging war on people god, and god’s prophet; conspiracy against Islam and fighting the clergies; participation in the incidents which occurred on 9 January 1978 in Qom; and putting warriors and the clergies at the seminary in exile” (Kayhan). It is not clear how and in what manner Mr. Mo’ini participated in these incidents.

On 9 January 1978, after the publication of an article named “Black and Red Reaction” in which the writer of the article, whose penname was Rashidi Motlaq, attacked Ayatollah Khomeini. This led to massive unrest in Qom in which the police interfered. The exact number of people who were killed in those incidents is unknown, but the resources close to the Islamic Government declared the number up to 15 dead and wounded.

Evidence of guilt

There is no information in the report of Kayhan that indicates the evidence of the prosecution office against Mr. Mo’ini. Only part of the report indicated that Mr. Mo’ini confirmed a part of the indictment (Kayhan). Kayhan’s report did not refer to any testimonies against Mr. Mo’ini or the existence of any plaintiffs.

According to Kayhan, Mr. Mo’ini said he was following the orders and added that when he detected any offenses or repression in SAVAK, he immediately took appropriate actions. He also gave an example about this matter (Kayhan).

Defense

No information is available on Mr. Mo’ini’s defense. There is no indication of the defendant’s lawyer in the entire news report, and it is not clear if he had access to other standards of effective defense such as summoning witnesses, questioning the prosecutor’s witnesses, etc.
